Federal customs regulation calls a duty a personal debt due from the importer to the United States. In February 2026 the Supreme Court put it in eleven words: tariffs “operate directly on domestic importers to raise revenue for the Treasury.” When the emergency tariffs were then held unlawful, an estimated $166 billion went back, with interest, to the American companies that had paid it.
00:00:00:00 Trailer  ·  :27  ·  Looping
The argument

A tariff has one debtor, and the law writes down which one.

The regulation is not ambiguous and it is not new. Liability for duties “constitutes a personal debt due from the importer to the United States which can be discharged only by payment in full.” It accrues on arrival. It takes priority over other creditors in insolvency. It is also a lien on the goods themselves. Paying a broker does not discharge it.1

In February 2026, deciding whether an emergency statute could be used to impose tariffs at all, the Supreme Court described what a tariff does before holding that it could not. Tariffs, the Court wrote, “operate directly on domestic importers to raise revenue for the Treasury” and are “very clear[ly] . . . a branch of the taxing power.” The petitioners in the lead case were, in the Court's own words, two small businesses.2

Then came the proof. With those tariffs unwound, the agency told the public what it was now obliged to hand back: an estimated $166 billion assessed over roughly twelve months, spread across more than fifty-three million entry summaries, refundable with required interest to an expected three hundred and thirty thousand filers. It had to build a new processing tool for the volume alone. The money did not go to a foreign government. It went to importers, because importers are who paid it.3

There are 240,535 identified American importing companies. Fewer than seven thousand of them have five hundred or more employees, and that small group carries most of the value; the other ninety-seven percent are the long tail that owns its own paperwork.4 Seventeen characters before the dot, no hyphen, no numeral, and it reads aloud exactly as it is spelled.
